Welcome to Getabunk.com. These Terms of Use govern your access to and use of the Getabunk.com website, mobile applications, and services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms of Use. Please read them carefully.

1. ACCEPTANCE OF TERMS

1.1 Getabunk.com is owned and operated by Goshago LLC ("Goshago," "we," "us," or "our"). By accessing or using our Platform, you ("User," "you," or "your") agree to comply with and be bound by these Terms of Use.

1.2 If you do not agree with any part of these terms, you should not access or use our Platform.

1.3 We reserve the right to modify these Terms of Use at any time. We will notify users of material changes by posting the new Terms of Use on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms of Use.

2. PLATFORM DESCRIPTION

2.1 Getabunk.com is an online marketplace that connects property hosts ("Hosts") with travelers seeking accommodations ("Travelers"). We provide a platform for Hosts to list properties and for Travelers to discover, book, and pay for accommodations.

2.2 Goshago LLC does not own, sell, resell, furnish, provide, rent, re-rent, manage, or control properties. Our responsibilities are limited to facilitating the availability of the Platform.

3. USER ACCOUNTS

3.1 To access certain features of the Platform, you must register and create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 You are solely responsible for safeguarding your password and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties, or for any other reason.

4. HOST TERMS

4.1 As a Host, you are responsible for creating and maintaining your property listings in an accurate and up-to-date manner, including availability, pricing, and property conditions.

4.2 You represent and warrant that you have all necessary rights and permissions to list your property on our Platform and to host Travelers.

4.3 You are solely responsible for determining the price for your listing, including any taxes, fees, or charges that may apply.

4.4 You agree to respond to booking requests from Travelers in a timely manner and to honor confirmed bookings.

4.5 You are responsible for compliance with all applicable laws, regulations, and third-party agreements that apply to your listing and hosting activities.

5. TRAVELER TERMS

5.1 As a Traveler, you agree to respect the property you rent and to comply with any property-specific rules or restrictions communicated by the Host.

5.2 You are responsible for leaving the property in the condition it was in when you arrived, except for normal wear and tear.

5.3 You agree to communicate with Hosts through our Platform regarding booking inquiries, stay details, and any issues that arise during your stay.

5.4 You understand that all bookings are subject to the cancellation policy selected by the Host for their listing.

6. BOOKING AND FINANCIAL TERMS

6.1 All payments and financial transactions must be conducted through the Platform unless explicitly permitted otherwise in writing by Goshago LLC.

6.2 You agree to pay all fees, including service fees, taxes, and other charges associated with your use of the Platform when due.

6.3 Hosts will receive payment for confirmed bookings according to the payment schedule outlined in our Host policies.

6.4 Cancellations and refunds will be handled according to the specific cancellation policy selected by the Host for their listing, as displayed prior to booking.

6.5 Bookings are confirmed when payment is received and confirmed by Getabunk.com. Getabunk.com will act as a payment processor and will hold payment until a set period of time after check-in, or until the stay has concluded, unless a dispute occurs.

7. PROHIBITED ACTIVITIES

7.1 You agree not to:

Violate any applicable laws or regulations
Infringe the rights of others, including privacy and intellectual property rights
Harass, threaten, or intimidate other users
Post false, inaccurate, misleading, deceptive, defamatory, or offensive content
Use the Platform for any illegal or unauthorized purpose
Attempt to gain unauthorized access to the Platform or user accounts
Interfere with the proper operation of the Platform
Bypass any measures we use to restrict access to the Platform
Scrape, data mine, or otherwise extract data from our Platform in an automated manner

8. INTELLECTUAL PROPERTY

8.1 The Platform and all content and materials available through the Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, are the property of Goshago LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Platform without our prior written consent, except as expressly permitted in these Terms of Use.

9. CONTENT LICENSE

9.1 By posting, uploading, or submitting content to our Platform, you grant Goshago LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of providing and promoting the Platform.

10. DISCLAIMER OF WARRANTIES

10.1 THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10.2 Goshago LLC does not warrant that the Platform will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

10.3 Goshago LLC does not endorse, verify, or guarantee the existence, conduct, performance, safety, quality, legality, or suitability of any Host, Traveler, property, or third-party content.

11. LIMITATION OF LIABILITY

11.1 IN NO EVENT SHALL GOSHAGO LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE PLATFORM.

11.2 IN NO EVENT WILL GOSHAGO LLC'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO GOSHAGO LLC IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

11.3 THE LIMITATIONS OF LIABILITY APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF GOSHAGO LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. INDEMNIFICATION

12.1 You agree to defend, indemnify, and hold harmless Goshago LLC, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Platform; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.

13. DISPUTE RESOLUTION

13.1 Any dispute arising from or relating to these Terms of Use or your use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.

13.2 The arbitration shall be conducted in [JURISDICTION], and the judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

13.3 You agree that any arbitration shall be limited to the dispute between you and Goshago LLC and shall not be joined with any other arbitration or consolidated with any other case or proceeding.

13.4 YOU UNDERSTAND THAT BY AGREEING TO THESE TERMS OF USE, YOU AND GOSHAGO LLC ARE EACH WAIVING THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

14. GOVERNING LAW

14.1 These Terms of Use and your use of the Platform shall be governed by and construed in accordance with the laws of [JURISDICTION], without regard to its conflict of law provisions.

15. TERMINATION

15.1 We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including, without limitation, breach of these Terms of Use.

15.2 Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request account deletion.

16. SEVERABILITY

16.1 If any provision of these Terms of Use is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms of Use will otherwise remain in full force and effect and enforceable.

17. ENTIRE AGREEMENT

17.1 These Terms of Use constitute the entire agreement between you and Goshago LLC regarding the Platform and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
